1. Agreement
By using Bloom, you agree to these Terms of Use. If you do not agree, please do not use the app or website. These terms form a binding agreement between you and Bloom, Nairobi, Kenya.
2. Not medical advice
⚠️ Important: Bloom is a wellness tool, not a medical device or clinical service. Nothing in Bloom constitutes medical advice, diagnosis or treatment. Always consult a qualified healthcare professional for medical decisions.
The Bloom Light AI assistant is a supportive tool only. It is not a therapist, psychiatrist, or emergency service. If you are in crisis, please contact your local emergency services or a crisis helpline immediately.
3. Who can use Bloom
- You must be 16 or older to create an account
- You must provide accurate information when signing up
- You may not use Bloom on behalf of someone else without their consent
4. Founding member access
Founding members (the first 1,000 sign-ups) receive free lifetime access to Bloom's core features. "Lifetime" means for as long as Bloom continues to operate. Bloom reserves the right to introduce premium features in future that are not included in the founding tier.
5. Your content
Journal entries, mood logs, and other data you create in Bloom belong to you. Bloom does not claim ownership of your content. By using Bloom, you grant us a limited licence to store and process your content solely to provide the service.
6. Acceptable use
You agree not to:
- Use Bloom for any unlawful purpose
- Attempt to reverse-engineer, scrape, or exploit the service
- Share your account with others
- Use Bloom to harm, harass, or exploit others
- Misrepresent yourself in community features
7. Availability & security
We aim for maximum uptime but cannot guarantee uninterrupted service. We may update, suspend, or discontinue features with reasonable notice. We will always give founding members advance notice of significant changes.
Bloom is built on a Zero Trust security architecture with medical-grade data encryption and multi-layer access controls. In the event of a confirmed data breach affecting personal data, we will notify affected users and the Office of the Data Protection Commissioner (ODPC), Kenya, and the Office of the Data Protection Commissioner (ODPC), Kenya in your jurisdiction within 72 hours as required by GDPR Article 33 and the Kenya Data Protection Act 2019.
8. Environmental commitment
Bloom operates under a legally binding Environmental Commitment Policy, available in full at mybloomworld.org/environment-policy. By using Bloom, you acknowledge the following:
- Bloom contributes a minimum of 1% of gross revenue annually to verified reforestation through Eden Reforestation Projects
- Bloom's digital infrastructure is operationally carbon neutral, running on Cloudflare's 100% renewable energy-powered global network
- Environmental claims made by Bloom comply with the EU Green Claims Directive (Directive 2024/825), the FTC Green Guides (16 CFR Part 260), and the UK CMA Green Claims Code
- Bloom is subject to the Kenya Environmental Management and Co-ordination Act (EMCA), Cap. 387, and the Kenya Climate Change Act, No. 11 of 2016
- An annual Environmental Impact Report is published by 31 March each year, covering the preceding financial year
The Grow Programme (optional user tree-planting add-on) is governed exclusively by the Environmental Commitment Policy. Bloom does not make any financial gain from Grow Programme contributions.
9. Limitation of liability
To the maximum extent permitted by Kenyan and applicable data protection law, Bloom is not liable for indirect, incidental, or consequential damages arising from your use of the app. Our total liability is limited to the amount you have paid us in the preceding 12 months (which, for founding members, is zero).
9. Governing law
These terms are governed by the laws of the Republic of Kenya and applicable EU regulations. Disputes will be resolved in Kenyan courts, unless EU consumer protection law grants you rights in your country of residence.
